SIGNAL INVESTIGATIONS: ACCEPTABLE USE POLICY
This Acceptable Use Policy (as updated by Signal Corporation from time to time) applies to all users of the Investigations Module (Service). By creating a search on this Service, you agree to comply with this policy.
This policy supplements, but does not replace or limit in any way, the Signal Corporation end user agreement you (or the organization you are accessing the Service on behalf of) have signed up to (End User Agreement). The End User Agreement governs your use of the Service and failure to comply with this policy constitutes a breach of the End User Agreement (by you or the organization that you are accessing the Service on behalf of).
Compliance with laws
In your access to and use of the Service and any data made available to you via the Service (Data):
· you will comply with all applicable laws and all guidelines, procedures and policies notified by Signal Corporation (on its website or otherwise) from time to time; and
· you will not use the Service or any Data for any illegal, unlawful or otherwise improper purpose.
Restrictions on use
You will not use the Service or any Data:
· to engage in any illegal, fraudulent or abusive behaviour;
· to analyse or research the Data in a way that isolates a small group of individuals or any single individual for any unlawful or discriminatory purposes;
· to determine a person’s eligibility for a Government license or in connection with eligibility for any Government benefit or service.
· for debt collection purposes;
· to determine a consumer’s eligibility for credit or insurance or to assess credit or prepayment risks associated with a consumer’s existing credit obligation;
· for the purposes of tenancy verification or an application to rent real property;
· for the purpose of evaluating an individual for employment, promotion, reassignment or retention as an employee;
· for any purpose covered by the Fair Credit Reporting Act (15 U.S.C Sec. 1681 et seq) and similar federal and state legislation;
· for any evidentiary purpose related to law enforcement or criminal prosecution;
· in a manner that Signal Corporation reasonably considers to be inconsistent with the intention of this policy, any third party data license agreements it is a party to, or the End User Agreement;
· in a manner designed to conduct any systematic or automated data collection activities, including without limitation, scraping, data mining, data extraction, or data harvesting; or
· in a manner that may damage, disable, overburden or impair either the Service or the networks connected to the Services.
You will keep the Data and all of your Service access details, including passwords and codes, confidential.
Privacy
In your access to and use of the Service and Data, you will comply with the Signal Corporation privacy policy (available on the Signal Corporation website) and all applicable privacy laws.
You will not use the Service or any Data:
· in a way that violates the privacy, rights or civil liberties of any person (including in a way that prevents the exercise of them);
· in such a way that would ordinarily be considered inconsistent with the reasonable expectation of privacy of an individual.
Disclaimers
Signal Corporation does not represent that the Service or the Data are error-free or will satisfy all of your requirements. Nor does Signal Corporation provide any warranties in respect of the accuracy, completeness timeliness or supply of any Data made available to you via the Service. Other than as expressly provided for in the End User Agreement, all warranties, conditions and representations, whether express or implied are hereby excluded.
Removal of Data
You acknowledge that Signal Corporation will delete from the Service the outputs from your search results within 42 days of the date of the relevant search being undertaken.
Breach of this policy
The fact that an investigations search has been undertaken will be tracked by Signal Corporation and if we consider that a breach of this policy has occurred, we may take such action as we deem appropriate. Without prejudice to any of our other rights or remedies in the End user Agreement, a breach of this policy may result in:
· withdrawal of your (or your organization’s) right to use the Service and/or any other Signal Corporation service;
· legal proceedings against you (or your organization), including for reimbursement of all costs on an indemnity basis resulting from the breach; and/or
· disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
